1. Agreement to Terms

By accessing or using Mailetic (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use our Service. These Terms apply to all users, including visitors, customers, and contributors.

2. About Mailetic

Mailetic is a managed email newsletter infrastructure service operated by Mailetic. We provide a hosted platform that enables newsletter creators and businesses to manage subscriber lists, create email campaigns, and deliver email through third-party SMTP providers including Amazon SES, SendGrid, Mailgun, and Elastic Email.

3. Eligibility

You must be at least 18 years old to use this Service. By agreeing to these Terms, you represent that you are of legal age to form a binding contract.

4. Account Registration

To use Mailetic, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Be responsible for all activities that occur under your account
  • Notify us immediately of any unauthorized use at support@mailetic.com

5. Acceptable Use Policy

You agree to use Mailetic only for lawful purposes. You must not use our Service to:

  • Send unsolicited commercial email (spam) of any kind
  • Send emails to purchased, rented, or scraped email lists
  • Promote illegal activities, violence, hate speech, or discrimination
  • Promote, advertise, or market alcohol or alcoholic beverages of any kind
  • Promote gambling, betting, lotteries, casinos, or any games of chance
  • Send, promote, or distribute sexually explicit, adult, or pornographic content of any kind
  • Distribute malware, phishing content, or fraudulent material
  • Violate any applicable laws or regulations, including CAN-SPAM, GDPR, and CASL
  • Infringe upon intellectual property rights of any third party
  • Impersonate any person or entity or misrepresent your affiliation

Violation of this policy may result in immediate account suspension or termination without refund.

6. Email Marketing Compliance

You are solely responsible for ensuring your email campaigns comply with all applicable laws, including:

  • CAN-SPAM Act (United States)
  • GDPR (European Union)
  • CASL (Canada)
  • Any other applicable local laws in your jurisdiction

You must have explicit permission from all recipients before sending them email through Mailetic. We reserve the right to suspend accounts that generate excessive bounce rates, spam complaints, or unsubscribe rates.

7. Subscription and Payment

Mailetic offers subscription-based plans starting at $19/month. Payments are processed through Paddle, our authorized payment processor. By subscribing, you agree to:

  • Pay all applicable fees for your selected plan
  • Authorize recurring charges on your billing cycle
  • Provide valid payment information at all times

We reserve the right to change pricing with 30 days’ notice to existing customers.

8. Free Trial

Where a free trial is offered, you may use the Service without charge for the trial period. At the end of the trial, your account will require a paid subscription to continue. We reserve the right to modify or cancel free trial terms at any time.

9. Intellectual Property

All content, features, and functionality of Mailetic, including but not limited to software, text, graphics, and logos, are the exclusive property of Mailetic and are protected by applicable intellectual property laws.

You retain ownership of all content you upload or send through the Service. By using our Service, you grant us a limited license to process and transmit your content solely for the purpose of providing the Service.

10. Third-Party Services

Mailetic integrates with third-party SMTP providers. We are not responsible for the performance, availability, or terms of these third-party services. Your use of such services is subject to their respective terms and policies.

11. Limitation of Liability

To the maximum extent permitted by law, Mailetic shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to lost profits, lost data, or business interruption.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the three months preceding the claim.

12. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. You may cancel your account at any time through your account settings or by contacting us. Termination does not entitle you to a refund except as outlined in our Refund Policy.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved through binding arbitration or in a court of competent jurisdiction.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or a prominent notice on our website. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
